Judge Napolitano on the Constitutionality of the Arizona Immigration Law



Napolitano thinks the bizarre twist here is that only eight of the justices will hear this in court because Justice Elena Kagan took herself off the case because of her past work with the Department of Justice in resisting the Arizona statute when she was in the Obama administration. If there’s a tie in the ruling, Napolitano says the decision made by a prior court is upheld, and that decision was that the Arizona law was unconstitutional.
